Inheritance Dispute Success


Tim Watson, our Inheritance Dispute Solicitor, has secured a substantial settlement for Mrs S in a complex Will and property dispute.

Mr S was married to Mr S, a farmer. Mr S jointly owned and ran a farm with his two brothers. Some of the farm was owned by the three brothers as individuals but some was owned through their company. The part that was owned by them individually was leased to the company. They also set-up and ran a holiday let business on the farm.

Mr S died in 2018. In his Will, Mr S left everything to Mrs S. A dispute arose between Mrs S and the two brothers about the valuation of the land and the company and how Mrs S was to realise her interest in each. The brothers tried to argue that the land had a significantly reduced value because it was subject to the lease in favour of the company. They also tried to force Mrs S to leave the farm.

In a complex and long-running dispute, involving issues including tax and mortgage liabilities, Tim was able to reach an agreement with the brothers without the need to issue court proceedings. The agreement provided for Mrs S to receive a significant cash lump sum and to remain living on the farm until the brothers were able to raise the necessary funds.
