Settlement Reached in Inheritance Claim


Tim Watson, our specialist Inheritance Dispute Solicitor, has secured a substantial settlement in an Inheritance Act Claim for Mrs B.

Mrs B’s partner, Mr T, died. They weren’t married. They lived together in a property owned solely by Mr T. Mr T also owned two other properties, which were let to tenants.

In his Will, Mr T passed everything to another Beneficiary. He did not provide at all for Mrs B because he had not updated his Will since the start of their relationship. This meant that Mrs B would have been forced to vacate her home, with nowhere to go and no money to buy her own home. She was retired and relied solely on her state pension.

Tim acted for Mrs B in bringing a claim under the Inheritance (Provision for Family and Dependants) Act 1975 (“the Act”). Under the Act, Mrs B was entitled to seek funds from Mr T’s Estate, even though she was not provided for in the Will, on the basis that it was not reasonable for not to receive anything.

Fortunately, Tim was able to secure an agreement with the Beneficiary that Mrs B receive:

  1. A life interest in the property she shared with Mr T as their home. This allows Mrs B to remain living in the property for the rest of her life;
  2. A payment of a six-figure sum from the Estate.

In addition, the Beneficiary paid Mrs B’s legal fees.

Tim was able to secure the above agreement without the need to go to court, avoiding lengthy and expensive court proceedings.
